What it is

The facts a commercial dispute turns on.

Who is really behind the counterparty. Where the money went. Who saw it happen.

Commercial cases are won on facts the other side does not volunteer — related entities, moved assets, former insiders and documented conduct. A business litigation investigation develops those facts through records, open sources and lawful field work, under the direction of counsel.

It sits alongside our broader civil litigation investigations work, focused on disputes between businesses, their owners and their counterparties.

Who this is for

Built for counsel on commercial matters.

  • Business & commercial litigators

Contract, partnership, shareholder, non-compete and trade-secret disputes — the facts behind the pleading, developed before and alongside discovery.

  • Corporate & in-house counsel

Investigative capacity for disputes with vendors, former insiders, competitors and counterparties, retained through counsel and scoped to the matter.

  • Judgment creditors & their counsel

Locate the debtor, map the entities around them and find what can be reached — so a judgment becomes a recovery plan.

What it includes

From pre-suit to judgment enforcement.

  • Pre-suit investigation

Before you file: who the opposing parties are, how they are organized, what they own, and whether a judgment would be collectible. Findings that shape the claims, the defendants and the venue.

  • Witness locates & background

Find former employees, insiders and third-party witnesses through skip tracing, then develop the background, prior litigation and potential bias counsel needs before contact or deposition.

  • Entity & related-party mapping

Officers, registered agents, members, shared addresses and successor entities — a documented map of the companies and people behind a counterparty, across states.

  • Assets, transfers & judgment enforcement

Asset searches across real property, vehicles, business interests and accounts, the transfer history counsel needs to evaluate a fraudulent-transfer theory, and post-judgment debtor locates and entity tracing for enforcement and turnover. Cryptocurrency starts with a Global CryptoScan account scan; on-chain tracing is a custom engagement on retainer.

  • Social media & OSINT

Social-media and open-source research across 700+ platforms, archived and source-cited — statements, relationships and activity that bear on the dispute.

  • Field interviews & surveillance

Witness interviews, site visits and surveillance where lawful and where conduct is at issue. Out-of-state field work is carried out through vetted partner investigators.

How it works

Directed by counsel. Verified by analysts.

  1. 01

    Scoped through counsel

Engagements are directed by the retaining attorney. We agree the questions, the subjects and the deliverable before work starts, so the investigation tracks the litigation strategy.

  2. 02

    Investigated & analyst-verified

Investigators work records, open sources and the field. An analyst verifies every finding against its source before it reaches the report.

  3. 03

    Delivered with chain of custody

Findings arrive through the secure client portal, source-cited, with documented chain of custody and SHA-256 hashed evidence.

Deliverables

What counsel receives.

  • Written report of findings, each fact cited to its source
  • Entity and related-party map for the counterparty
  • Asset schedule with ownership and transfer history
  • Witness locate and background summaries
  • Archived social-media and open-source captures
  • Field and surveillance reports where lawful field work is ordered

FAQ

Business litigation investigations, explained.

What is a business litigation investigation?
A business litigation investigation is licensed, counsel-directed fact-finding for commercial disputes: locating assets and witnesses, mapping entities and related parties, and documenting conduct — delivered as sourced findings with chain of custody. OnTrial works on commercial matters through the retaining attorney, so the investigation follows counsel's strategy and the findings are built for use in the case.
What does a business litigation investigator do before a lawsuit is filed?
Pre-suit investigation identifies the right parties, maps how they are organized, locates key witnesses and assesses whether a judgment would be collectible. Counsel uses those findings to decide whom to sue, which claims to plead and where to file. Asset searches and entity mapping are usually the starting point.
Can you trace assets moved to related entities or insiders?
Yes. We map the officers, members, addresses and successor entities around a party, then document ownership and transfer history for real property, vehicles, business interests and accounts. That record supports counsel's evaluation of a fraudulent-transfer theory and later judgment enforcement. Cryptocurrency starts with a Global CryptoScan account scan; on-chain tracing is a custom engagement on retainer.
Do you work in Texas state court, federal court and the Texas Business Court?
Our work supports matters in Texas state and federal courts, including disputes in the Texas Business Court, and commercial cases nationwide. OnTrial, LLC is licensed by the Texas Department of Public Safety (Private Investigations Company License #C31261501); field work outside Texas is carried out through vetted partner investigators.
Do you provide digital forensics?
Not device forensics. Our business-litigation work is open-source and records research, asset and entity investigation, witness work, and lawful field work and surveillance. We do not image devices or perform forensic data extraction; counsel retains a forensic examiner for that work.
How long does a business litigation investigation take?
Scope sets the timeline. Individual reports follow published turnarounds — for example, Complete (US) Asset Search returns in 7–10 business days standard (rush 3–5). Background 360 returns in 4–5 business days standard (rush 3–4). Multi-part matters are scheduled with counsel around filing and hearing dates.
Who directs the investigation and receives the findings?
The retaining attorney. Engagements are scoped through counsel, findings are delivered through the secure client portal, and every fact is analyst-verified and cited to its source with documented chain of custody. See litigation support for how firms order.
